With your access to our websites, information about the access (date, time, pageviewed, IP address) is stored as  logfiles on our server. We do this for the legitimate interest of monitoring technical operations, optimising our information and detecting attacks on our website. These data are evaluated by us exclusively for our own statistical purposes, in anonymous form.

The log files are deleted after three months.

Normally, no personal data is collected by us when you use our website. If you contact us via the contact forms provided or subscribe to our newsletter, your email address and other personal data will only be used for individual correspondence to answer your request. We guarantee that your information will be used exclusively by us, will not be passed on and will be treated confidentially in accordance with the applicable legal provisions. An exception is the transfer to processors who work exclusively on the instructions of Martini Sportswear GmbH, do not use the data for their own purposes and are bound by their own agreements to the data protection obligations of the General Data Protection Regulation.

You have the right to access, to rectification and erasure of your data, the right to restriction of processing, to object to processing (in particular the objection to the sending of direct marketing) and the right to lodge a complaint with a supervisory authority.

General Enquiries

The data of your request (name, contact details, content of the request, history of previous contacts with us), which you send via the contact form or us by e-mail, will be processed by us for customer service (pre-contractual measures) and for marketing purposes (legitimate interest in sending direct advertising by mail). Your data will be deleted by us 3 years after your last request, unless there are legal obligations to store the data.

Newsletter Subscription / Mailchimp

The newsletter will only be sent with your consent by entering your data and your e-mail address and clicking on the button "Sign Up" and clicking on the confirmation link in the confirmation e-mail automatically sent (double opt-in).

To withdraw your consent, each newsletter contains an option to unsubscribe. The withdrawal does not affect the legal basis valid until the withdrawal.

In addition to your e-mail address, we also process information about your usage behavior when reading the newsletter, e.g. which articles are read particularly often. We use this information to make our content more interesting and suitable for you.

By subscribing to the newsletter, you also agree that we may transmit your data to The Rocket Science Group, LLC (675 Ponce de Leon Ave NE, Suite 5000, Atlanta, GA 30308 USA), which provides the newsletter tool Mailchimp and  which processes your data in the USA. Online Shop

The data you enter will be processed for the purpose of ordering and delivering products and services, carrying out sales activities, accounting or bookkeeping, customer service and sending direct marketing.

The processing takes place on the legal basis of a contract with customers or pre-contractual measures for interested parties as well as for the legitimate interest of Martini Sportswear GmbH for the sending of direct advertising.

Names and contact details, payment information, any agreements as well as the communication or order history are processed.

The provision of the aforementioned data is necessary for the business relationship, as contractual or legal obligations cannot otherwise be complied with.

The data will be stored for a period of three years from the last contact after expiry of the statutory retention obligations.

Payment service provider Mollie

For the processing of payments in our online shop, we work together with the payment service provider Mollie B.V. (Keizersgracht 126, 1015CW Amsterdam, Netherlands). As part of your order processing and on the basis of the contract that arises when you conclude an order between you and Martini Sportswear GmbH, your contact and transaction data and technical telemetry data will be transmitted to Mollie. Your data will be passed on exclusively for the purpose of payment processing with the payment service provider  Mollie and only to the extent that it is necessary for the fulfilment of the contract. Payment service provider PayPal

If you decide to pay with the online payment service provider PayPal during your order process, your data will be transmitted to PayPal as part of the order. PayPal is offered by Pay Pal (Europe) S.à.r.l. & Cie. S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg. PayPal assumes the function of an online payment service provider and a trustee and offers buyer protection services. The personal data transmitted to PayPal are usually first name, last name, address, telephone number, IP address, e-mail address, or other data necessary for order processing, as well as data related to the order, such as number of items, invoice amount and taxes in percent, billing information and the like. Integration of Google services

We use Google Sign-In to provide a simplified login process for our online shop, Google Analytics for error analysis and statistical evaluations, Google Tag Manager to integrate additional Google services, Google DoubleClick to display and distribute online advertising, and Google Ads conversion tracking to measure clicks and conversions.

With your consent, we also embed YouTube videos and Google Maps, which are likewise provided by Google.

We also use Google Ads Enhanced Conversions. These help us to record purchases or bookings generated through advertisements more accurately and to close potential tracking gaps. In this context, purchasers’ personal data, such as names and email addresses, are transmitted to Google in encrypted form. Enhanced Conversions allow Google to attribute certain purchases to a previous click on an advertisement even where cookies have meanwhile been deleted from the browser.

The data are hashed before being transmitted to Google. Hashing means that, for the purpose of transmission, the data are not encrypted in the traditional sense but are converted into a randomly generated code. The SHA-256 one-way hashing algorithm, which is considered secure, is used for this purpose. Google uses the hashed data to determine whether a person was signed in to a Google Account at the time of purchase. Where this is the case, the person may also be identified as a purchaser without the use of cookies.

Facebook Pixel / Meta Advanced Matching

In certain cases, we place advertisements on the Facebook social media platform, which is operated by Meta Platforms Ireland Ltd., Merrion Road, Dublin 4, D04 X2K5, Ireland (“Facebook”). When you click on such an advertisement, you will be redirected to our website.

The Facebook Pixel is used on our website exclusively with your consent. The information obtained through the Pixel enables us to evaluate which advertisements are particularly successful. For this purpose, the pages of our website that are visited after a user clicks on an advertisement are recorded.

We also use the “Meta Advanced Matching” service on our website. This tool is intended to enable website visitors to be matched more accurately with existing user profiles on Meta platforms such as Facebook or Instagram, thereby increasing the effectiveness of our advertising campaigns. In this context, additional information such as email address, telephone number, name, date of birth or address data entered, for example, in forms may be collected and matched against existing Meta profiles.

Depending on its configuration, the Meta Pixel may automatically or manually identify input fields in which personal data are entered. These data are hashed in the browser using a SHA-256 algorithm before being transmitted to Meta. This process pseudonymises the data and ensures that they are not transmitted in plain text.

Meta uses the hashed information to attribute conversions, such as purchases, more accurately to individual users, including across different devices. This particularly improves audience creation through Custom Audiences, performance measurement and retargeting.

The following technologies are used for this purpose:

• JavaScript to integrate the Pixel and collect data in the browser
• Tracking pixels to record user actions and events
• Optional cookies and Local Storage to recognise users across multiple sessions or to store events; the use of cookies can be disabled
• Encrypted and hashed data transmission using SHA-256

The retention period for the data is determined by Meta’s requirements and the applicable statutory retention obligations. The data will be deleted once these periods have expired. Microsoft Advertising/Bing Ads

With your consent, our website uses the remarketing tool "Bing Ads" from Microsoft Corporation One Microsoft Way, Redmond, WA 98052-6399, USA. ("Microsoft Advertising"). Microsoft Bing Ads stores a cookie on your computer if you have reached our website via a Microsoft Bing ad. In this way, Microsoft Bing and we can recognize that someone has clicked on an ad, has been redirected to our website and has reached a previously determined landing page (conversion page). We use fraud0, a service provided by fraud0 GmbH Sendlinger Straße 7, 80331 Munich, to detect invalid traffic and low-quality traffic and to prevent fraud on our website. By using the fraud0 service we can detect invalid traffic on our site, improve our online marketing efforts, clean marketing-relevant statistics and improve the usability of our website. 

The data obtained from this service is only used for analysis and mitigation of invalid and low-quality traffic. fraud0 processes data on our behalf and is contractually committed to measures to ensure the confidentiality of the processed data. A data processing agreement with fraud0 has been concluded. The fraud0 technology uses JavaScript pixels. During your website visit, the following data are collected by or through the use of this service:

In our admin interface From fraud0 we receive a classification for invalid and low quality traffic, no personal data. There is no transfer of data to third parties - except as otherwise stated in our data processing agreement with you. When invalid or low quality traffic is detected, we generate invalid audience lists using our tag manager to automatically de-targeted this traffic across all our major buying channels like GoogleAds, Facebook, DV360 etc. Data processing by fraud0 only continues until a classification  is done. 

Tracking across websites does not happen at any time. We process data by using the fraud0 bot detection service based on Art. 6 lit. f GDPR. It is in the interest of the website operator to classify the users of its website as valid or as invalid traffic. First and foremost, we are preventing fraud (recital 47 of the GDPR), but we can also correct the website statistics by removing invalid traffic shares from our statistics. This will allow us to use our online marketing budget more efficiently and therefore continue to provide our services (as usual/free of charge/at a reasonable price).
