CONDITIONS OF PARTICIPATION RAFFLE

1. General

1.1. The organizer of the competition is Martini-Sportswear GMBH, 5524 Annaberg 133

1.2. Participation in the competition takes place exclusively through Martini Sportswear.

1.3. Participation is only possible from December 27th, 2021 to December 30th, 2021, 12 noon (hereinafter referred to as the "competition period").

1.4. Only persons over the age of 18 are eligible to participate.

1.5. Employees of the organizers, their relatives and other people involved in the implementation of the competition are excluded from participation.

1.6. By participating, the participant declares that he agrees to these conditions of participation.

2. Prize

2.1. At the end of the competition period, the organizer will randomly select a winner from all admitted participants (drawing of lots). The prize includes: A shirt, model "Andina" from Martini Sportswear. If this is no longer in stock, a shirt of similar value will be used. Colors may change due to stock availability.

2.2. The winners will be informed of the prize on December 30th, 2021 by comment and direct message from Martini Sportswear

2.3. The winner must confirm receipt of the notification in accordance with 2.2 within 48 hours of receipt by means of a reply to the message. Any information for the purpose of transferring the prize must also be transmitted.

2.4. If the winner does not comply with his obligation to confirm and provide information in accordance with point 2.3 in due time, the organizer reserves the right to exclude the winner from the competition and to raffle the prize again.

3. Other

3.1. In the event of an unavoidable event (e.g. natural disasters, strikes, data accidents, bankruptcies, etc.), the organizer reserves the right to change the prize appropriately or to refrain from holding the competition or awarding the prize entirely.

3.2. The organizer is not liable for the usability or usefulness of the prize for the winner as well as for disruptions and damage in claiming the prize, provided that they are beyond the organizer's sphere of influence. This applies in particular to damage caused by different people from the organizer and his employees when claiming the prize.

3.3. In addition, the organizer is only liable for damage in connection with the competition in cases of gross negligence. The organizer is liable to the legal extent for personal injury.

3.4. For disputes arising from these conditions of participation or in connection with the competition, the exclusive jurisdiction of the competent court for 5524 Annaberg-Lungötz is agreed.

 

3.5. For disputes arising from these conditions of participation or in connection with the competition, Austrian substantive law applies exclusively, excluding the Austrian reference norms.
